Smoke Free Work Places
On Monday April 30th 2007 The Smoking (Northern Ireland) Order 2006 legislation came into effect to ensure that all enclosed work spaces, including vehicles, would be smoke free (with some limited exceptions such as designated rooms in residential care homes) thus reducing the health impacts of smoking, particularly passive smoking.
Smoking in a smoke free premises carries a fixed penalty notice of £50 (reduced to £30 if paid in 15 days) for the person smoking, or a maximum fine of £1,000 if prosecuted and convicted by a court.
Allowing smoking in a smoke-free place or vehicle if you have management responsibilities in respect of either carries a maximum fine of £2,500 if prosecuted and convicted by a court.
Smoking in Work Vehicles
Smoking in a smoke free work vehicle carries a fixed penalty notice of £50 (reduced to £30 if paid in 15 days) for the person smoking, or a maximum fine of £1,000 if prosecuted and convicted by a court. The legislation requires all vehicles used for public transport or as any other work vehicle to be smoke free at all times which includes when they do not have passengers.
