Comments on the Proposed Changes to the LDP dPS are now Available to View

Following detailed consideration of the Representations received to its LDP draft Plan Strategy published in December 2019, Derry City & Strabane District Council is now proposing a number of changes to the LDP draft Plan Strategy. Sustainability Appraisal (SA)

The Planning Act (NI) 2011, sections 8(6) and 9(7) requires an appraisal of sustainability to be carried out for the LDP Plan Strategy. A SA must cover social and economic effects of the LDP as well as any environmental effects by complying with EU SEA Directive 2001/42/EC on the Assessment of Effects of Certain Plans and Programmes on the Environment (SEA Directive). This Addendum and any outcomes should be read in conjunction with the already published December 2019 SA Report.

 

Habitats Regulation Assessment (HRA)

The Conservation (Natural Habitats, etc.) Regulations (NI) 1995 (as amended), Regulation 43, requires an Appropriate Assessment to be undertaken of plans and projects which are likely to have a significant effect on an international site in NI, either alone or in combination with other plans or projects.

 

Equality Impact Assessment (EQIA)

Section 75 of the Northern Ireland Act 1998 requires all public bodies, in carrying out their functions relating to Northern Ireland, to have due regard to the need for equal opportunities.

 

Rural Needs Impact Assessment

The Rural Needs Act 2016 requires district councils to have due regard to rural needs when developing, adopting, implementing or revising policies, strategies and plans and when designing and delivering public services

 

How to View Documents and Submit Comments: Consultation Now Closed

The Schedule of Proposed Changes and the supporting Addendum Reports will be subject to a formal 8-week public consultation from 9th December 2021 to 3rd February 2022. Comments may be submitted on the Proposed Changes or any of the Appraisal documents.

Comments made should only address and relate to the soundness of the proposed changes.  This consultation is not an opportunity to add to any previously submitted representations, or to make new comments on parts of the original Draft Plan Strategy. Any such comments will be disregarded. Copies of the Schedule of Proposed Changes and supporting assessments will also be available for inspection during normal office opening hours, strictly by appointment only, due to the ongoing COVID-19 situation, from 9th December 2021 at the Council’s two main offices at 98 Strand Road, Derry, BT48 7NN and 47 Derry Road, Strabane, Co. Tyrone, BT82 8DY.

It should be noted that comments received cannot be treated as confidential. All comments will be made available for public inspection and placed on the Council’s website. However, all personal contact details (personal telephone numbers, email addresses, signatures and sensitive personal data) will be redacted and will remain confidential. A copy of comments will be supplied to the Department for Infrastructure and the Planning Appeals Commission as part of the Independent Examination process.
