Independent Planning Review – Lismacarrol Road
The purpose of this review is to provide independent assurance to the Council in relation to 2 elements relating to the handling of the planning application.
Firstly, to undertake an exercise in establishing if officers acted reasonably and in line with appropriate professional planning standards in the assessment of whether an earlier planning application on the site had commenced,
Secondly, to undertake an exercise of reviewing the decision-making processes leading to the judicial review including the entirety of the evidence under-pinning it under reference to the affidavits provided by planning officials to the court with a view to assessing
- whether the decisions and recommendations made accorded with appropriate and acceptable standards of professional planning judgement and
- whether they conducted their assessment in a manner indicating that no reasonable professional planner, properly informed, would have done.
whether contra-indicating evidence was, or ought to have been, before those officials (and if so what) and assessing how they approached the assessment of that evidence and if such evidence was treated and assessed reasonably and in accordance with appropriate and acceptable standards of professional planning judgement.
