Any person affected by an alleged statutory nuisance who wishes to take their own legal action also has the option to make a direct application to the court of summary jurisdiction by using the provisions in Section 70 of the Clean Neighbourhoods and Environment (Northern Ireland) Act 2011. An individual can seek an order from the court to require the person causing the nuisance to abate the nuisance or to prphibit a recurrence of the nuisance. Contravention of such an order of the court is an offence and liable on summary conviction to a fine. Any individual considering this approach should take advice from their own solicitor.
