This type of nuisance deals mainly with dwellings. If a property is in a condition that is harmful to health or is causing a nuisance (e.g. damp and disrepair in one property is causing a statutory nuisance at a neighbouring property), it can be addressed under this section of the legislation, with Council having a duty to investigate.

For example, dampness in properties can result in a number of negative effects depending on the type of dampness (rising, penetrating or condensation). Dampness can result in structural damage and make properties harder to heat. Certain types of dampness issues can also contribute to condensation which if persistent, can result in fungal mould growth which can produce spores which can affect the health of tenants.
