Fumes or Gases Emitted from Private Dwellings

This section relates to any fumes or gases resulting from activities on one premises, which is causing a nuisance to, or is injurious to the health of, occupants at a different premises.

Definitions
  1. ”fumes” means any airborne solid matter smaller than dust. 
  2. “gas” includes vapour and moisture precipitated from vapour.
The most common use of this provision would be to deal with exhaust fumes from heating equipment affecting a neighbouring property, it could also be used to control somebody respraying cars at home causing nuisance from vapour carry-over.
